Data we process

We collect personal data through the following channels:

  • Contact form: name, surname, email address, telephone (optional), subject and message.
  • Virtual assistant (chatbot): conversation content voluntarily entered by the user, which may include name, email or telephone if the user chooses to share them.

Purposes of processing

Personal data collected is processed for the following purposes:

  • Managing commercial enquiries and information requests.
  • Sending quotations and commercial proposals requested by the user.
  • Maintaining communication with potential clients.
  • Operating the virtual assistant to answer questions about our boats and services.

Data retention

Personal data will be retained for as long as necessary to manage the user's enquiry and, subsequently, for the statutory limitation period applicable to any legal claims (up to 5 years under Article 1964 of the Spanish Civil Code).

Chatbot data is not stored on Stay Nautica's servers beyond the active browser session.

Data recipients

Personal data will not be shared with third parties unrelated to the provision of the service, except for the following data processors:

  • OVHcloud — Hosting and corporate email provider, with servers located in the European Union.
  • Anthropic, PBC — Provider of the AI model powering the virtual assistant, located in the United States. It only receives data that the user voluntarily enters in the chat. Anthropic does not use messages sent through its API to train its models.
  • SysFinance / Iberian Finance Services, S.L. — Only if the user chooses to use the embedded financing calculator, in which case SysFinance's own privacy policy will additionally apply.

International transfers

Data sent to the virtual assistant may be transferred to Anthropic, PBC, based in the United States. Anthropic participates in the EU-US Data Privacy Framework, which ensures an adequate level of protection in accordance with the European Commission's adequacy decision of 10 July 2023.

Your rights

You may exercise the following rights at any time:

  • Right of access to your personal data.
  • Right to rectification of inaccurate or incomplete data.
  • Right to erasure ("right to be forgotten").
  • Right to object to processing.
  • Right to restriction of processing.
  • Right to data portability.
  • Right not to be subject to automated decisions, including profiling.

To exercise these rights, please contact info@staynautica.com attaching a copy of your ID document.

You also have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

Security measures

Stay Nautica S.L. implements reasonable technical and organisational measures to protect users' personal data against unauthorised access, loss, alteration or destruction. Communication with the server is secured via HTTPS with TLS encryption.

Minors

This website is not intended for children under 14 years of age. Stay Nautica does not knowingly collect personal data from minors. If we become aware that we have collected data from a minor without the consent of their legal representative, we will promptly delete it.
